EPA keeps existing stormwater permit in place

The Environmental Protection Agency (EPA) elected to retain the 2021 Multi Sector General Permit (MSGP) for stormwater discharges rather than implement a revised permit.

As a result, there are no new federal PFAS stormwater monitoring requirements for asphalt mix plants. Federal stormwater permitting requirements will continue as they have since 2021.

Additionally, EPA issued a No Action Assurance letter through Feb. 28, 2027, allowing continued compliance under the existing stormwater permitting requirements.

Some states are incorporating portions of EPA’s Proposed 2026 MSGP, including PFAS monitoring requirements for asphalt mix plants. NAPA encourages members to understand their state’s specific stormwater reporting requirements.
