EPA withdraws proposed hazardous waste definition

On May 8, the Environmental Protection Agency (EPA) withdrew a 2024 proposed rule that would have made PFAS and other hazardous constituents subject to the Resource Conservation and Recovery Act’s corrective action program.
While this action eases some potential burdens associated with defining PFAS-containing materials as a “hazardous waste,” the PFAS CERCLA/Superfund definition and liability concerns remain in place.
The withdrawal is the latest example of the Trump administration’s careful reconsideration of the impact of PFAS regulatory standards. In 2025, the agency partially rolled back drinking water standards for PFAS.
